Docs Must Disclose Risk Of Unseen Conditions: Texas Court

Law360, New York (November 30, 2012, 8:50 PM EST) -- To avoid negligence claims, health care practitioners must disclose the possibility that a patient’s undetected medical condition could lead to serious side effects during treatment, the Texas Supreme Court ruled Friday.

The high court’s decision revived the case of a patient who suffered a stroke during neck manipulation treatment, saying a chiropractor had erred by failing to disclose the procedure might cause a torn artery.
