FTC Sends 18 Warning Letters Over Anti-Concussion Equipment

Law360, New York (November 30, 2012, 5:19 PM EST) -- The Federal Trade Commission on Thursday announced it sent warning letters to 18 sports equipment manufacturers over potentially deceptive claims involving anti-concussion merchandise and that it finalized a settlement with mouthguard marketer Brain-Pad Inc. over related misconduct.

The FTC wouldn’t divulge the companies’ names but released a sample warning letter sent Nov. 7 in which it “strongly recommends” manufacturers take notice of the Brain-Pad case and review their marketing materials and product labeling to ensure they have science to back up athlete-protection claims.
