5th Circ. Lets Liberty Off Hook In Drilling Coverage Suit

Law360, New York (December 3, 2012, 4:03 PM EST) -- The Fifth Circuit ruled Thursday that Liberty Mutual Insurance Co. had no duty to defend an oil and gas company against lawsuits it faced after a well was drilled in the wrong place, holding the underlying claims weren't for property damage. 

Though PPI Technology Services LP's commercial general liability policy generally covered property damage claims and the underlying lawsuits did mention property damage, the Fifth Circuit concluded that no coverage was warranted because the property damage claims weren't backed up by specific factual allegations.
