Citizens Bank, PNC Hit With Suits Over ATM Fee Notices

Law360, New York (December 4, 2012, 9:42 PM EST) -- Citizens Bank of Pennsylvania and PNC Bank NA were hit with proposed class actions Monday alleging the banks imposed fees on their ATM users without providing proper advance notice of the charges.

The two nearly identical complaints filed in Pennsylvania federal court accuse the banks of failing to meet Electronic Fund Transfer Act requirements that ATM machines must have a posted notice in a “prominent and conspicuous location on or at the machine” informing consumers of ATM surcharges, and that the notice must be given “before...
