Spanair Crash Suit Belongs In US, 9th Circ. Hears

Law360, Los Angeles (December 3, 2012, 7:43 PM EST) -- Survivors and relatives of the victims of a Spanish airliner crash urged the Ninth Circuit on Monday to reinstate their suit against Boeing Co., saying a federal judge did not appreciate the "unique features" of the case when he found Spain was a more appropriate venue.

Plaintiffs' attorney Stephen Rosenthal said the dismissal of the case should be reversed because U.S. District Judge Gary Allen Feess did not recognize that the only disputed issue is whether a technical defect in the aircraft, a McDonnell Douglas MD-82,...
