CIBC Win In Leasing Suit Still Stands, Judge Rules

Law360, New York (December 6, 2012, 2:44 PM EST) -- Metro Commercial Real Estate Inc. on Wednesday lost its bid to reopen a lawsuit alleging Canadian Imperial Bank of Commerce Inc. owes the company commissions for a CIBC-financed shopping center, after a Pennsylvania federal judge said his previous dismissal stands.

Metro said the court “misapprehended the law and facts” when it analyzed the company's unjust enrichment claim in an Oct. 25 decision, but U.S. District Judge John R. Padova said the court correctly applied the law, and declined to reopen the case.
