Continental On Hook For Technicolor Cleanup Court Costs Only

Law360, New York (December 6, 2012, 7:01 PM EST) -- An Indiana appeals court on Thursday said Technicolor Inc.’s successor can recover courtroom costs stemming from the cleanup of three contaminated film-processing sites from Continental Casualty Co., but not losses resulting from orders from administrative agencies.

Thomson Inc., which the appeals court said acquired Technicolor’s assets in 2001, had appealed a lower court’s ruling that found Continental was only responsible for the courtroom costs.

After Thomson’s acquisition of Technicolor, local environmental authorities directed Thomson to remediate the contamination at the sites, for which Thomson seeks indemnification...
