Litgo Urges 3rd Circ.To Hold US Liable For Polluted Site

Law360, New York (December 7, 2012, 3:12 PM EST) -- Litgo New Jersey Inc. asked the Third Circuit on Wednesday to reverse a New Jersey federal court's allocation of cleanup costs at a polluted military site, arguing that the lower court abused its discretion by assigning Litgo a majority of the costs while largely letting the U.S. government off the hook. 

Litgo contends the New Jersey federal court erred in deciding it must assume most of the millions in cleanup costs because it was aware of the groundwater contamination prior to purchasing the site.
