States Announce Plan To Sue EPA Over Methane Emissions

Law360, New York (December 11, 2012, 5:58 PM EST) -- Seven states plan to sue the U.S. Environmental Protection Agency for failing to address climate change by neglecting to enact a more stringent methane emissions standard for oil and gas operations, including hydraulic fracturing, they said Tuesday.

A coalition of attorneys general led by New York's Eric T. Schneiderman is claiming that the agency broke the law by deferring a decision on whether to update new source performance standards for methane produced by the oil and gas industry.
