'Santa Claus Is Comin' To Town' Rights Suit Tossed

Law360, New York (December 11, 2012, 7:04 PM EST) -- A Florida federal judge on Tuesday shut down a composer's heirs' bid to recover the copyright to the song “Santa Claus is Comin' to Town,” ruling the plaintiffs hadn't established that the court had personal jurisdiction over defendant EMI Feist Catalog Inc.

U.S. District Judge Kenneth Marra dismissed the case without leave to amend. He noted the plaintiffs already had a chance to amend their complaint, but said they could seek a ruling on the merits before a court with proper jurisdiction.
