Judge Throws Out Distress Claims In Water Suit

Law360, New York (November 14, 2007, 12:00 AM EST) -- A judge has dismissed claims brought by thirteen plaintiffs alleging that Remco Hydraulics Inc. and other companies intentionally inflicted emotional distress when they allegedly contaminated the water in an area of California.

Judge Susan Illston of the U.S. District Court for the Northern District of California said in a ruling Tuesday that the plaintiffs failed to provide evidence to proceed with the emotional distress claims. Litigation over a number of other claims, however, is ongoing.
