Bimbo Discovery Bid In FLSA Suit Nixed As 'Burdensome'

Law360, Los Angeles (December 13, 2012, 1:47 PM EST) -- A Pennsylvania federal judge on Tuesday dismissed a request by Bimbo Bakeries USA to serve written discovery on every opt-in plaintiff involved in a proposed class action alleging the bakery misclassifies drivers as independent contractors, finding the request "overly burdensome."

In his opinion, U.S. District Judge Mitchell S. Goldberg said the parties had submitted “vastly different proposals” for the appropriate discovery process for final certification and definition of the class. The case was conditionally certified in February.
