Judge Seeks More Info In Enviro Suit Coverage Battle

Law360, New York (December 12, 2012, 5:22 PM EST) -- A federal judge on Wednesday put on hold, but declined to dismiss, third-party coverage claims made by three insurers against Lumbermens Mutual Casualty Co. and American Motorists Insurance Co. in a proposed class action over toxic vapors allegedly released from an Illinois manufacturing facility.

Both Lumbermens and American Motorists are involved in rehabilitation proceedings with the Illinois Department of Insurance because they are having trouble staying afloat, and U.S. District Judge Barbara R. Crabb said she’ll give both sides two weeks to prove whether the coverage...
