NY Localities Have Legal Right To Ban Fracking, NRDC Argues

Law360, New York (December 13, 2012, 2:45 PM EST) -- Dryden, N.Y., has the legal right to protect its desirability as a place to live against risks associated with heavy industrial activity like high-volume hydraulic fracturing, the National Resources Defense Council said Tuesday, after it filed an appellate brief in a fight over “home rule” power.
