Calif. Jury Throws Out Factory Worker's 'Popcorn Lung' Case

Law360, Los Angeles (December 13, 2012, 9:38 PM EST) -- In the first so-called popcorn-lung case to be tried in California, a jury on Thursday rejected the claims of a former flavoring factory worker who alleged his exposure to the chemical diacetyl distributed by Advanced Biotech Inc. caused him to develop a severe lung condition.

After a three-month trial, the Los Angeles Superior Court panel found Advanced Biotech had negligently supplied diacetyl to Wilfredo Velasquez's employer and had knowledge of the chemical's risks. But in a 9-3 vote, the jury absolved the company of liability, saying...
