'Pink Slime' Co. Escapes Ex-Worker's WARN Suit For Now

Law360, Wilmington (December 14, 2012, 3:39 PM EST) -- A Delaware bankruptcy judge on Friday tossed a putative class action brought by an ex-AFA Foods Inc. employee, finding the suit against the “pink slime” beef filler maker and its private equity parent lacked the factual foundation to pass the pleading stage.

Filed by Nadia Sanchez, the complaint alleged bankrupt AFA and solvent parent Yucaipa Corporate Initiatives Fund II LLC violated the Worker Adjustment and Retraining Notification Act by terminating her and some 200 co-workers without notice just days after the meat processor's bankruptcy filing....
