Texas High Court Will Rehear Malpractice Damages Dispute

Law360, Dallas (December 14, 2012, 8:21 PM EST) -- The Texas Supreme Court on Friday agreed to hear a doctor’s appeal of a $14 million malpractice award after a tug-of-war between state trial and appellate courts over how much he’s required to pay and which court has the authority to enforce the judgment.

The state Supreme Court, which in 2009 struck part of the judgment against OB-GYN Benny Phillips as exceeding a statutory cap, has agreed to hear arguments about whether it had the exclusive jurisdiction to enforce its mandate after the case was remanded...
