DC Circ. Orders NLRB To Revisit Offensive T-Shirt Ruling

Law360, New York (December 14, 2012, 8:49 PM EST) -- The D.C. Circuit ordered the National Labor Relations Board on Friday to reconsider its ruling that a Medco Health Solutions Inc. unit breached federal labor laws by asking a worker to remove a shirt the company believed could offend clients.

The labor board ruled last year that Medco Health Solutions of Las Vegas Inc. violated the National Labor Relations Act by forcing a unionized pharmacist to remove a T-shirt that mocked a company rewards program. The worker wore the shirt when clients were touring the building....
