Feds Seek Hard Time For Asbestos Fraudster At 2nd Circ.

Law360, New York (December 17, 2012, 7:49 PM EST) -- An asbestos worker convicted of misleading his clients about air quality after so-called rip and run abatement operations deserves to have his sentence of probation upped to prison sentence, prosecutors argued before the Second Circuit on Monday.

A lower court failed to consider evidence showing that Mark Desnoyers, convicted of fraud and conspiracy to violate the Clean Air Act in September 2008, was dishonest at a new job, Assistant U.S. Attorney Rajit S. Dosanjh argued at oral arguments before a panel of judges in Manhattan....
