Penguin Settles DOJ's E-Books Price-Fixing Case

Law360, New York (December 18, 2012, 7:29 PM EST) -- Penguin Group USA Inc. agreed Tuesday to settle the U.S. Department of Justice's claims that it conspired with Apple Inc. and four other publishers to fix the price of e-books, taking the same deal the antitrust watchdog reached with three other defendants.

The settlement will resolve the DOJ's claims that Penguin colluded with Apple and the other publishers to fix e-book prices in the run-up to the 2010 launch of Apple's iBookstore, in part by switching from the traditional wholesale model to an agency sales model,...
