Microsoft Appeals $565M Eolas Patent Case To Supreme Court

Law360, New York (September 14, 2005, 12:00 AM EDT) -- In an appeal of the $561 million patent lawsuit brought by Eolas Technologies, Microsoft has asked the U.S. Supreme Court to decide whether software code can qualify as a “component” of a patented invention.

Microsoft is asking the Supreme Court to decide whether U.S. law bans exports of infringing products when all that is supplied is software code that foreign computer manufacturers use to program computers that are made and sold outside the U.S.
