DC Circ. Won't Rehear Greenhouse Gas Endangerment Case

Law360, New York (December 20, 2012, 4:26 PM EST) -- The D.C. Circuit on Thursday shot down a request from states and energy industry advocates to rehear en banc a suit over the U.S. Environmental Protection Agency's conclusion that greenhouse gas emissions threaten human health and welfare, solidifying a June decision upholding federal air pollution regulation.

Voting 6-2 against the petition for rehearing en banc, the appeals court said that the U.S. Supreme Court's 2007 decision in Massachusetts v. EPA clearly held that the Clean Air Act's definition of air pollutants  “unambiguously includes greenhouse gases,” and...
