Texas Can't Stop Federal Defunding Of Women's Health Program

Law360, Houston (December 21, 2012, 8:11 PM EST) -- A Texas federal judge on Friday denied a bid to block a decision by the U.S. Department of Health and Human Services to cut Medicaid funding to the state’s Women’s Health Program because it excludes abortion service providers.

U.S. District Judge Walter Smith denied Texas’ request for a preliminary injunction, indicating in a docket sheet entry that the state “did not prove the four elements required to issue a preliminary injunction.”
