Pa. High Court To Debate Access To Mental Health Records

Law360, Philadelphia (January 2, 2013, 6:17 PM EST) -- The Pennsylvania Supreme Court last week said it would consider a case about whether defendants can access plaintiffs' mental health records under the state's Mental Health Procedures Act, even if plaintiffs amend complaints to remove any claims related to mental health damages.

The case centers around a man who was struck by a tractor-trailer during an incident the Pennsylvania State Police later classified as an attempted suicide. The man's wife filed suit against the driver of the truck and the Pennsylvania Department of Transportation claiming negligence...
