Court Keeps $7.5M Insurance Ruling In Spite Of Dissent

Law360, Dallas (January 2, 2013, 7:11 PM EST) -- A Texas appeals court on Friday refused to rehear RSUI Indemnity Co.’s fight to avoid paying $7.5 million in excess coverage to The Lynd Co. for damage caused during 2005’s Hurricane Rita — despite a sharp dissent that said the result was “absurd.”

In a 4-3 ruling, the Fourth Court of Appeals declined to reconsider en banc a March ruling that awarded Lynd $7.5 million, including interest and attorneys' fees on top of about $4 million that Lynd sought from RSUI under an excess coverage policy...
