9th Circ. Denies Oil Brokers' Bid To Rehear Iraq Oil Suit

Law360, New York (January 3, 2013, 8:29 PM EST) -- The Ninth Circuit on Thursday denied two Cyprus-based oil brokers' request for en banc review of a July decision dismissing breach-of-contract claims against the Republic of Iraq, drawing a fierce dissent accusing the court of wrongly splitting the fight between two jurisdictions.

In their petition for en banc review, Pentonville Developers Ltd. and Marblearch Trading Ltd. argued that the Ninth Circuit's decision, which reversed a California federal court's ruling in favor of the oil brokers, conflicted with other circuit courts over jurisdiction. Iraq was wrong to appeal...
