Ex-Primary Global Exec Can't Shake Conviction In 2nd Circ.

Law360, New York (January 8, 2013, 2:27 PM EST) -- The Second Circuit refused Tuesday to overturn a guilty verdict against James Fleishman, a former Primary Global Research LLP sales executive sentenced to 2 1/2 years in prison based in part on wiretap evidence implicating him in an insider trading ring.

Fleishman had opposed the government's use of a “trunk line” wiretap that eavesdropped on phone conversations involving 104 individuals, claiming in an April 11 appeal brief that prosecutors had violated the Fourth Amendment because they did not have probable cause to suspect wrongdoing by 93...
