Rite Aid, Others Jump Into Pay-For-Delay MDL Against Pfizer

Law360, New York (January 9, 2013, 5:13 PM EST) -- Rite Aid Corp. and others sued Pfizer Inc.'s King Pharmaceuticals Inc. in Tennessee federal court Friday, joining multidistrict litigation that alleges King settled a patent dispute with a deal to keep generic Skelaxin off the market, raising the muscle relaxant's price.

Rite Aid, Maxi Drug Inc., which operates as Brooks Pharmacy, and Eckerd Corp. threw themselves into the MDL, lodging an antitrust complaint against King and generic-drug maker Mutual Pharmaceutical Co. Inc. The suit alleges, among other things, that King and Mutual settled a patent dispute...
