Nursing Homes Sue Calif. Health Dept. Over Arbitration Law

Law360, Los Angeles (January 10, 2013, 7:44 PM EST) -- Six skilled nursing facilities and a nursing facility lobby group sued the California Department of Public Health and the state of California on Tuesday, alleging that the state unlawfully prevents nursing home residents from resolving claims against nursing facilities through alternative dispute resolution programs.

Lead plaintiff Valley View Health Care Inc. claims the Federal Arbitration Act preempts a California law barring the arbitration of claims brought under the California Health & Safety Code.
