Vt. Pushes 2nd Circ. To Kill Entergy Nuclear Plant

Law360, New York (January 14, 2013, 8:02 PM EST) -- Vermont on Monday asked the Second Circuit to allow it to shut down an Entergy Corp. nuclear power plant, saying it has the right to decide what kinds of facilities operate within its borders.

The state wants the appeals court to uphold two laws that gave the state legislature authority over whether to allow Entergy's Yankee Vermont plant to operate past 2012. Built in 1972, the 605-megawatt plant is the only nuclear-generating facility in the state.
