Pom Loses FTC Appeal Of False Health Claims Ruling

Law360, New York (January 16, 2013, 4:29 PM EST) -- The U.S. Federal Trade Commission announced Wednesday it had upheld and expanded upon an administrative law judge's decision finding Pom Wonderful LLC’s advertisements made false and misleading claims that its pomegranate drinks and supplement could fight diseases.

In a unanimous vote, the commission issued a final order barring Pom from making any claim that a food, drug or dietary supplement is “effective in the diagnosis, cure, mitigation, treatment or prevention of any disease,” including heart disease, prostate cancer and erectile dysfunction, unless the claim was supported...
