Abbott Fires Off Suit Over Seizure Treatment

Law360, New York (November 26, 2007, 12:00 AM EST) -- Abbott Laboratories has taken aim at a drug delivery company for seeking to make and sell a generic version of Abbott’s epileptic seizure medicine Depakote.

The Illinois-based pharmaceutical company lodged a patent infringement suit in the U.S. District Court for the District of Delaware on Nov. 21, claiming that Banner Pharmacaps Inc.’s new drug application requests federal approval to market its copycat treatment before Abbott’s two patents covering the branded treatment expire early next year.
