Actelion Says Antitrust Law Can't Make It Sell To Rivals

Law360, New York (January 17, 2013, 2:41 PM EST) -- Actelion Pharmaceuticals Ltd. on Wednesday pressed a New Jersey federal court for a judgment in its case against Apotex Inc. and other drugmakers that are seeking to buy samples of its patented blood pressure medication, saying no antitrust law compels it to do business with its rivals.

Switzerland-based Actelion brought its suit in September seeking a declaratory judgment that antitrust laws don’t require it to supply its Tracleer medication to other pharmaceutical companies to aid in the development of generics.
