Red Bull No Better Than Coffee, False Ad Suit Claims

Law360, Los Angeles (January 17, 2013, 8:44 PM EST) -- Red Bull GmbH was hit with a putative class action in New York federal court Wednesday alleging the company's high-profile ads claiming that the drink "vitalizes body and mind" amount to false advertising because the drinks allegedly provide no more energy than a cup of coffee or a caffeine pill.

Wednesday's lawsuit, filed Benjamin Careathers on behalf of all consumers of Red Bull branded energy drinks, raises allegations that the Austria-based beverage company and its U.S. subsidiaries defrauds consumers through systematic practices of disseminating false and misleading information via television commercials, radio media and other advertisements.
