Continental Fights Coverage Of ‘Popcorn Lung’ Suits

Law360, Los Angeles (January 18, 2013, 7:56 PM EST) -- Continental Casualty Co. sued aromatic chemical supplier Citrus and Allied Essences Ltd. and its insurers Thursday seeking to limit liability in so-called “popcorn lung” suits alleging bodily injury from exposure to the butter-flavoring chemical diacetyl in Citrus’ products, saying primary insurance policies aren’t yet exhausted.

Thursday’s lawsuit challenges insurance liability in lawsuits brought by consumers who say they developed respiratory and pulmonary injuries and diseases, including bronchiolitis obliterans, from their exposure to diacetyl in Citrus' products in 2006 and 2007.
