SEC Defeats Suit Over Destroyed Madoff, Goldman Docs

Law360, New York (January 18, 2013, 2:01 PM EST) -- A Washington federal judge on Thursday tossed a government watchdog group's suit seeking the restoration of destroyed documents from U.S. Securities and Exchange Commission preliminary investigations, including probes into Bernie Madoff and Goldman Sachs Group Inc.

U.S. District Judge James E. Boasberg said that the SEC had sufficiently fulfilled its duties under federal records laws to obtain and recover the documents requested by Citizens for Responsibility and Ethics in Washington, saying the agency handled the requests on an “urgent” and “time-sensitive” basis.
