High Court Refuses To Extend Medicare Appeals Deadline

Law360, New York (January 22, 2013, 11:50 AM EST) -- In a unanimous decision issued Tuesday, the U.S. Supreme Court ruled that the Medicare Act does not allow for the extension of a reimbursement appeals deadline, a blow to hospitals seeking to rectify several years' worth of underpayments.

In Sebelius v. Auburn Regional Medical Center et al., several hospitals argued that the statutory 180-day deadline to file an appeal with the Provider Reimbursement Review Board should be extended when the hospitals couldn't have known that their reimbursements were based on faulty agency data.
