DOJ Takes Document Fight To 7th Circ. In Superfund Row

Law360, Chicago (January 23, 2013, 5:00 PM EST) -- The U.S. Department of Justice told the Seventh Circuit on Wednesday that it shouldn't have to abide by a Freedom of Information Act request tied to a suit over cleanup at Wisconsin's Lower Fox River Superfund site since the documents at issue are privileged.

Samantha L. Chaifetz of the DOJ's civil division asked the three-judge appeals panel to overturn a Wisconsin federal judge's January 2012 ruling that ordered the government to produce documents sought by packaging company Menasha Corp. and the Neenah-Menasha Sewerage Commission.
