EEOC's Racial Discrimination Suit Against Kaplan Tossed

Law360, New York (January 28, 2013, 9:49 PM EST) -- Kaplan Higher Education Corp. won summary judgment Monday in its battle with the U.S. Equal Employment Opportunity Commission, ending a two-year dispute over Kaplan's use of credit checks as part of its hiring process, which the EEOC deemed racially discriminatory.

U.S. District Judge Patricia A. Gaughan found that the “race rating” system EEOC's expert used to assess the effect Kaplan's credit check system had on minority applications was not scientifically sound enough to produce admissible results.
