Cephalon, SciMedica Can't Derail TCPA Class Action

Law360, Chicago (January 29, 2013, 3:34 PM EST) -- Drugmaker Cephalon Inc. and medical marketing firm SciMedica Group LLC lost their bid to have a junk fax putative class action tossed for lack of standing Monday, when a Pennsylvania federal judge found the plaintiff had alleged an injury the Telephone Consumer Protection Act was designed to address.

In an order dated Friday and entered on the docket Monday, U.S. District Judge Legrome D. Davis Jr. shot down the defendants' argument that Physicians Healthsource Inc. lacked standing for its suit.
