State Gets Second Shot With Alco Superfund Appeal

Law360 (November 28, 2007, 12:00 AM EST) -- A years-old case over toxic waste cleanup at Alco Pacific Inc.'s former lead processing facility in California will head back to the Central District of California, after an appeals court ruled that the district court was wrong to grant summary judgment to the alleged polluters.

The appeal, brought by the California Department of Toxic Substances Control, sought to reverse a summary judgment ruling handed down in the U.S. District Court for the Central District of California in February 2004.
