CVS Is Underfunding $34M OT Settlement, Plaintiffs Say

Law360, New York (January 30, 2013, 6:20 PM EST) -- Fourteen months after CVS Caremark Corp. agreed to pay $34 million to resolve claims that the pharmacy failed to pay proper overtime to assistant store managers, the class members complained Tuesday that CVS was underfunding the settlement.

The plaintiffs in 11 consolidated wage-and-hour class actions asked U.S. District Judge John J. McConnell to force CVS to hand over an additional $1.9 million that the pharmacy has allegedly failed to pay as part of the November 2011 settlement.
