HHS Signals Flexibility On ACA's Individual Mandate

Law360, New York (January 30, 2013, 5:57 PM EST) -- Seeking to allay public concern, the Obama administration Wednesday said it would be flexible when enforcing the Affordable Care Act’s mandate for individuals to obtain health insurance, proposing an expanded definition of minimum coverage, new hardship exemptions and additional leeway on financial penalties.

In a proposed rule, the U.S. Department of Health and Human Services said it would recognize five alternative types of medical coverage as satisfying the mandate despite not being specifically identified in the landmark legislation.
