Convicted Tyco Execs Lose Bid For Habeas In 2nd Circ.

Law360, New York (February 4, 2013, 5:26 PM EST) -- Two Tyco International Ltd. executives convicted of stealing more than $100 million from the company are not entitled to a writ of habeas corpus, the Second Circuit ruled Monday, saying the men failed to raise their legal objections soon enough.

An appeals court panel said that Tyco's former CEO L. Dennis Kozlowski and onetime CFO Mark H. Swartz, who in September 2005 began serving prison terms for embezzlement-related charges, did not raise a constitutional issue challenge to the evidence in their case early enough.
