Judge Rejects Tyco Exec's Plea To Toss SEC Suit

Law360, New York (November 30, 2007, 12:00 AM EST) -- The last of the Tyco International Ltd trio to face charges by the U.S. Securities and Exchange Commission over a massive accounting fraud scam has lost his bid to have the case thrown out.

Manhattan District Court Judge D. J. Sweet on Thursday denied moves to dismiss the case by Richard D. Power, ruling the SEC's complaint had met the standard for accusing the former executive of an active role in the conspiracy to inflate the industrial conglomerate's operating income by $600 million.
