Fla. Developer's $19M Payout Not Covered, 11th Circ. Hears

Law360, Miami (February 6, 2013, 6:20 PM EST) -- Mt. Hawley Insurance Co. on Wednesday asked the Eleventh Circuit to affirm a ruling that the insurer does not have to indemnify a Florida real estate developer for a $19 million settlement with homeowners, arguing that the policy's pollution exclusion clearly bars coverage.

In oral arguments in Miami, Mt. Hawley's attorney Maureen Pearcy of Hinshaw & Culbertson LLP said that each count of the underlying complaint by the homeowners stems from pollution allegedly released during construction on the site of a former chemical and waste dump....
