$15M Award Is End Of The Line In Subway Tech Suit: 2nd Circ.

Law360, New York (February 6, 2013, 3:37 PM EST) -- The Second Circuit on Wednesday affirmed a trial judge’s finding that train equipment manufacturer Wabtec Corp. copied rival Faiveley Transport USA Inc.’s trade secrets involving braking technology used in New York City's subway system, but knocked a jury's damages award down to $15 million.

Though the appeals court ordered Faiveley to willingly reduce a damages award from $18.1 million to $15 million or face a new damages trial, it otherwise agreed with U.S. District Judge Jed Rakoff that Wabtec had misappropriated Faiveley's proprietary technology. The Second...
