Court Limits Evidence In ERISA Suit

Law360, New York (November 30, 2007, 12:00 AM EST) -- An appeals court ruled on Friday that a district court erred in deciding to force the Life Insurance Company of North America to pay a former Sprint employee long-term disability benefits by allowing evidence from outside the benefit plan's administrative record.

“I'm disappointed,” said Mark Kane, an attorney for the plaintiff, Lynn Jewell. Kane said that he did not intend to appeal the decision, but that he believes Jewell has a good case to argue on remand based on the administrative record alone.
