USPTO Deals First Blow To Genentech Patent

Law360, New York (September 29, 2005, 12:00 AM EDT) -- The U.S. Patent and Trademark Office has issued a preliminary ruling against a Genentech patent for a method of making antibodies that brings in millions of dollars in annual royalties.

Examiners said that the patent in question, issued in 2001, covers the same inventions as another patent held by Genentech, set to expire in March 2006.

Although some analysts have been quick to assume this indicates Genetech’s patent will eventually be revoked, other experts say it is too early in the process to predict the outcome....
