CollegeSource Owed No Coverage In IP Row, 9th Circ. Finds

Law360, New York (February 12, 2013, 1:56 PM EST) -- The Ninth Circuit on Monday said Travelers Indemnity Co. had no duty to defend higher education information provider CollegeSource Inc.'s fight against a competitor's trademark infringement suit, finding that the claims fall under the insurance policy's unauthorized use exclusion.

Upholding a district court ruling granting Travelers' motion for judgment on the pleadings, a three-judge panel said that rival AcademyOne's suit accusing CollegeSource of ripping off its domain name concerns activity “similar to” the unauthorized use of a product that could mislead consumers.
